Release of Liability & Assumption of Risk

This Release of Liability & Assumption of Risk applies to all Mister Weekend experiences, outings, getaways, hosted activities, travel planning services, social experiences, and related offerings.
By booking, attending, joining, or participating in a Mister Weekend experience, you acknowledge and agree to the terms below.
1. About Mister Weekend Experiences
Mister Weekend curates and hosts social travel experiences, outings, getaways, and related services using independent third-party suppliers.
These suppliers may include venues, restaurants, bars, beach clubs, yacht providers, transportation companies, hotels, guides, activity operators, and other local partners.
Mister Weekend does not own, operate, manage, or control the venues, vessels, hotels, restaurants, bars, beach clubs, transportation providers, tour companies, activity operators, or other third-party suppliers involved in an experience.
Mister Weekend is not a hotel, airline, cruise line, yacht operator, transportation company, restaurant, bar, beach club, tour operator, activity operator, or alcohol provider.
2. Voluntary Participation
Your participation in any Mister Weekend experience is voluntary.
You understand that travel, nightlife, social outings, boating, transportation, walking, water-adjacent activities, dining, entertainment, and destination experiences involve risks.
You are responsible for deciding whether an experience is appropriate for you based on your health, fitness, comfort level, personal circumstances, travel plans, and risk tolerance.
3. Assumption of Risk
You understand and voluntarily assume all risks associated with participating in a Mister Weekend experience.
These risks may include, but are not limited to:
slips, trips, falls, uneven sidewalks, stairs, crowds, traffic, transportation incidents, boating or water-related risks, ocean conditions, weather conditions, heat, dehydration, illness, injury, food or beverage reactions, alcohol-related environments, theft, loss of property, venue incidents, supplier negligence, criminal activity, delays, cancellations, emotional distress, and other known or unknown risks.
You understand that some experiences may take place in public places, nightlife venues, beach clubs, restaurants, boats, transportation vehicles, hotels, or other third-party locations that Mister Weekend does not control.
You accept full responsibility for your participation and for any injury, illness, loss, damage, expense, or harm that may result.
4. Third-Party Suppliers
Mister Weekend may coordinate or host experiences that involve independent third-party suppliers.
These suppliers are responsible for their own services, facilities, staff, equipment, vehicles, vessels, food, beverages, alcohol service, licensing, insurance, operations, safety procedures, and legal compliance.
Mister Weekend is not responsible for the acts, omissions, negligence, delays, cancellations, closures, safety decisions, refusal of service, operational decisions, equipment issues, accidents, injuries, or service quality of any third-party supplier.
If a supplier changes, cancels, modifies, delays, or refuses service, Mister Weekend will make reasonable efforts to assist with available alternatives, but Mister Weekend does not guarantee refunds, credits, substitutions, or specific outcomes.
5. Alcohol and Nightlife Environments
Mister Weekend does not sell, serve, furnish, or provide alcohol.
Any alcoholic beverages are sold, served, or provided by independent third-party venues, restaurants, bars, beach clubs, yacht providers, hotels, or other licensed suppliers, subject to their own rules and applicable laws.
You are responsible for drinking responsibly and making safe decisions.
You understand that alcohol-related environments may involve increased risk, including impaired judgment, accidents, injury, conflict, theft, refusal of entry, refusal of service, or removal from a venue.
Mister Weekend is not responsible for harm, injury, loss, damage, or expenses related to alcohol consumption, intoxication, venue decisions, supplier decisions, or the conduct of other guests or members of the public.
6. Age and Identification
Guests must be at least 18 years old to participate in Mister Weekend experiences unless a higher age requirement is stated for a specific experience or required by a venue, supplier, destination, or applicable law.
You are responsible for carrying valid government-issued identification and complying with all destination, supplier, and venue requirements.
Mister Weekend is not responsible if you are denied entry, refused service, removed from an experience, or unable to participate because you do not meet age, identification, dress code, behavior, health, safety, or supplier requirements.
7. Health and Personal Fitness
You are responsible for determining whether you are physically, mentally, and medically able to participate in an experience.
You should not participate in an experience if you have a medical condition, injury, illness, disability, allergy, medication issue, mobility limitation, or other concern that may make participation unsafe or unsuitable without first consulting a qualified medical professional.
You are responsible for your own medications, health needs, food allergies, dietary restrictions, mobility needs, and personal safety.
Mister Weekend does not provide medical advice, medical supervision, emergency medical care, or health screening.
8. Travel Documents and Personal Responsibility
You are responsible for your own travel documents, passport, visa, identification, entry requirements, transportation, accommodations, travel insurance, health needs, medications, personal belongings, and personal decisions.
Mister Weekend is not responsible for denied entry, missed flights, missed transportation, missed departures, missed inclusions, lost items, theft, injury, illness, additional expenses, or disruption caused by your failure to meet travel, venue, supplier, or destination requirements.
9. Weather, Ocean Conditions, and Safety Decisions
Experiences may be affected by weather, ocean conditions, traffic, supplier availability, venue operations, government restrictions, safety concerns, emergencies, or other circumstances outside Mister Weekend’s control.
Suppliers may modify, delay, postpone, or cancel an experience due to weather, ocean conditions, safety concerns, operational issues, or destination conditions.
You agree that weather-related changes, safety decisions, supplier decisions, destination conditions, and operational adjustments do not automatically qualify you for a refund, credit, or transfer from Mister Weekend.
10. Guest Conduct
You agree to behave respectfully, responsibly, and safely during all Mister Weekend experiences.
You agree not to harass, threaten, discriminate against, endanger, abuse, or disrupt other guests, hosts, suppliers, venue staff, members of the public, or local communities.
You also agree to follow all instructions from Mister Weekend hosts, suppliers, venue staff, transportation providers, security personnel, and local authorities.
Mister Weekend may remove or refuse service to any guest who creates a safety concern, appears intoxicated, behaves aggressively, violates venue or supplier rules, damages property, harasses others, refuses to follow instructions, or disrupts the experience.
No refund, credit, or transfer will be provided if you are removed from an experience, denied entry, refused service, or unable to participate because of your conduct, intoxication, lack of valid identification, or failure to comply with supplier, venue, or destination rules.
11. Release of Claims
To the fullest extent permitted by law, you release Mister Weekend, its owner, hosts, contractors, representatives, partners, affiliates, service providers, and agents from any and all claims, demands, damages, losses, liabilities, costs, expenses, actions, or causes of action arising from or related to your booking, attendance, travel, participation, or involvement in any Mister Weekend experience.
This release includes claims related to injury, illness, death, emotional distress, property loss, theft, property damage, missed travel, delays, cancellations, supplier actions, supplier negligence, venue incidents, transportation incidents, alcohol-related environments, weather, ocean conditions, destination conditions, public spaces, other guests, members of the public, and circumstances outside Mister Weekend’s reasonable control.
This release does not apply to any liability that cannot legally be released under applicable law.
12. Limitation of Liability
To the fullest extent permitted by law, Mister Weekend’s total liability for any claim arising from or related to your booking, participation, or experience will not exceed the amount you paid directly to Mister Weekend for the specific experience giving rise to the claim.
Mister Weekend will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost opportunities, travel expenses, emotional distress, inconvenience, reputational harm, or other indirect losses.
13. Indemnification
You agree to indemnify, defend, and hold harmless Mister Weekend, its owner, hosts, contractors, representatives, partners, affiliates, service providers, and agents from and against any claims, damages, losses, liabilities, costs, expenses, or demands, including reasonable legal fees, arising from or related to:
your participation in an experience; your conduct; your violation of this Release; your violation of Mister Weekend’s Terms & Conditions or Booking & Cancellation Policy; your violation of any law, venue rule, supplier requirement, or third-party right; your failure to provide accurate information; or the conduct of any guest in your party.
14. Emergency Assistance
In the event of an emergency, Mister Weekend may attempt to assist you by contacting local emergency services, suppliers, transportation providers, or emergency contacts.
However, Mister Weekend does not provide medical care, security services, rescue services, or emergency response services.
You are responsible for your own safety, medical decisions, emergency expenses, insurance coverage, and follow-up care.
15. Travel Insurance Strongly Recommended
Mister Weekend strongly recommends purchasing travel insurance for all getaways, destination experiences, boating activities, transportation-involved experiences, weather-sensitive activities, and non-refundable bookings.
Travel insurance may help protect you from unexpected illness, injury, delays, cancellations, emergencies, weather issues, supplier changes, medical expenses, evacuation needs, and other disruptions.
You are responsible for deciding whether to purchase travel insurance and for reviewing the terms of any insurance policy.
16. Photos and Media
Mister Weekend or its representatives may capture photos or videos during certain experiences for social media, marketing, documentation, or promotional purposes.
If you do not want to be photographed or recorded, you must notify Mister Weekend in writing before the experience begins.
Mister Weekend will make reasonable efforts to honor your request, but cannot control photos or videos taken by venues, suppliers, other guests, members of the public, or third parties.
17. Binding Effect
This Release applies to you and, to the extent permitted by law, your heirs, family members, estate, representatives, successors, assigns, emergency contacts, and anyone asserting a claim on your behalf.
If you book on behalf of another guest, you are responsible for ensuring that each guest reviews and accepts this Release before participating.
18. Governing Law
This Release is governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.
By booking, attending, or participating in a Mister Weekend experience, you agree that Texas law applies to this Release and to any dispute involving Mister Weekend, except where prohibited by applicable law.
19. Severability
If any part of this Release is found to be invalid, unlawful, or unenforceable, the remaining sections will remain in full force and effect.
The invalid or unenforceable section will be interpreted as closely as possible to its original intent while remaining enforceable under applicable law.
20. Acknowledgment
By booking, attending, joining, or participating in a Mister Weekend experience, you acknowledge that:
you have read and understood this Release of Liability & Assumption of Risk;
you understand that participation involves risk;
you voluntarily choose to participate;
you accept responsibility for your own conduct, safety, travel decisions, and personal belongings;
you understand that Mister Weekend uses independent third-party suppliers;
you understand that Mister Weekend does not sell, serve, furnish, or provide alcohol;
and you agree to release Mister Weekend from liability to the fullest extent permitted by law.
